Contributor Agreement


Preamble

The primary purpose of the Contributor Agreement is to grant Rivermap rights to share user submitted information as widely as possible with the paddling community, both directly and via other organisations, while allowing contributors to retain rights to their original work.

The agreement also attempts to protect Rivermap from some risks that arise from accepting user submissions.



Contributor Agreement

This Contributor Agreement ("Agreement") is entered into by and between rivermap.org ("Rivermap") and the user ("the Contributor") submitting content to Rivermap.

1. Contributor Content:

The Contributor agrees to submit text, images, and other content ("the Content") to Rivermap.

2. Grant of Rights:

The Contributor grants to Rivermap a non-exclusive, royalty-free, worldwide licence to use, reproduce, distribute, display, perform, store, retrieve, translate and transform the Content in connection with Rivermap and its operations. This licence includes the right to sublicense the Content to other users of Rivermap.

3. Ownership:

The Contributor retains ownership of the Content submitted to Rivermap. Nothing in this Agreement shall transfer ownership of the Content to Rivermap.

4. Representations and Warranties:

The Contributor represents and warrants that:
- The Contributor has the right to grant the licence in Section 2 above.
- The Content does not infringe upon any intellectual property rights or other rights of any third party.
- The Content complies with all applicable laws and regulations.

5. Indemnification:

The Contributor agrees to indemnify, defend, and hold harmless Rivermap and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to the Content submitted by the Contributor. In particular, they alone are responsible, financially and/or legally, for the potential damages to people's rights, privacy rights, human dignity rights and copyrights that submitting the Content may cause.

6. Termination:

Rivermap reserves the right to modify, remove, or refuse to display the Content in whole or in part, at its sole discretion, without notice, consent or compensation. Rivermap is not responsible for any consequences arising from such actions.

7. Governing Law:

This Agreement shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of laws principles.

8. Entire Agreement:

This Agreement constitutes the entire agreement between the parties concerning the subject matter hereof and supersedes all prior agreements and understandings, whether written or oral, relating to the same subject matter.

By submitting the Content to Rivermap, the Contributor agrees to be bound by the terms of this Agreement.
